The National Assembly,
Having regard to the FAAVM Charter, the FAAVM Constitution and the FAAVM Federal By-Laws,
Pursuant to FAAVM By-Law No. 09, incorporated and approved by Industry Canada, adopted by the Board of Governors,
Adopts the present Rules of Procedures of the Board of Governors on the Operations of the FAAVM Canada as an International Canadian Charity, which have been approved by the Board of Governors at the 37th meeting of the National Assembly.
Organization of the FAAVM as an
International Canadian Charity
FAAVM Charitable Activities and Governance
Rule 1
The services provided by the FAAVM Canada (hereinafter referred to as the Charity shall be free.
Rule 2
The FAAVM Canada is a not-for-profit organization and shall pursue its purposes and objectives by conducting and organizing various activities aiming to furthering its mandate without profitable gain.
Rule 3
The FAAVM raises its monies solely by organizing fundraising activities and soliciting benevolent contribution before other organizations with similar interests, and/or other related activities.
Rule 4
Minimal membership fees may be required for administrative purposes, whereby such fees are tax deductible where applicable.
Rule 5
The FAAVM Canada shall not issue tax-deductible documentation for contributions less than $125.00.
Rule 6
A written request is required for the issuance of tax-deductible documentation lesser than $125.00, and, such request must include the taxation year and ending period.
Rule 7
The FAAVM when participating in multiple activity events may not guarantee its free services, should the main organizational parties be other than the FAAVM itself.
Rule 8
Fundraising activities such as fundraising galas, and other special events may require monetary fees, in such, the board of governors shall instruct the public of the specific purpose of the collection of such funds.
Rule 9
The FAAVM may organize private activities and may collect minimal free willed contributions to cover related costs, and shall inform the participants of the costs involved and the amount collected.
Rule 10
The FAAVM shall promote its free services to the grand public, the private sectors, governments, and to other organizations nationally and internationally.
Rule 11
It is a serious offence to organize any such activities and/or events under the name of FAAVM Canada for profits and monetary gains without written authorization by FAAVM governing authorities; perpetrators shall be prosecuted under the law for such offence.
Rule 12
Donations, government funding, personal donations, corporate grants shall solely contribute to furthering the purposes of the FAAVM and not of its personnel.
Rule 13
The FAAVM shall abide by the Canada Customs and Revenue Agency's taxation principles in relations to its charitable activities across Canada and overseas.
Rule 14
When providing its services outside of Canada, and where tax-deductible documentations are required, the board of governors shall communicate with the proper authorities in order to familiarize itself with taxation laws of such country or countries.
Rule 15
The board of governors shall strive to promote FAAVM's free service nationally and internationally in accordance with the FAAVM constitution, the FAAVM Charter and other governing instruments in the language of the targeted groups or communities where applicable by law.
Rule 16
Following consultation with the President and CEO, the Secretary General shall transmit to the board of governors a draft agenda simultaneously with the notification of all free available services the FAAVM offers.
Rule 17
The FAAVM shall accordingly publish and advertise the official list of free services offered and available within.
Rule 18
Should a free service advertised become unavailable to the public, the board of governors shall meet in special session as soon as possible to withdraw such service between the official list in accordance with rule 17, and advise accordingly of the reasons of such change and a date if possible that such a service may become available again.
Rule 19
In accordance with rule 10 and rule 15, additional promotional activities shall be conducted in specific communities where new free services become available.
Rule 20
The present Rules of Procedures of the Board of Governors on the Operations of the FAAVM Canada as an International Canadian Charity is subject to amendments where the National Assembly may deem necessary.
Rule 21
Membership fees do not constitute services provided by the FAAVM Canada and shall therefore be considered otherwise, and managed by other governing instruments thereinafter.
Rule 22
There shall be a monitoring division, which mandate is to ensure that FAAVM free services are provided free of charge.
Rule 23
The National Assembly may place a request for cancellation of a free service, if such service is being offensive to the public, and/or part of the public.
Amendments
Rule 24
These rules may be amended by a decision taken by a majority of the ordinary members of the Board of Governors. Such amendments are subject to the approval of the National Assembly. Prior to the approval of the Board of Governors, amendments to these rules may be provisionally applied by the National Assembly.
